Background Check - Standards/Outcomes



Each application review and background check is conducted individually. Each decision is based on the unique facts associated with the particular applicant's situation and application.

Standards for Denial of License

The decision to issue or deny a license is based on the following standards found in Wis Admin Code §PI 34.35(7):

  • a) The state superintendent shall deny, refuse to renew or refuse to revalidate a license as provided in Wis Stats §118.19(1m)(a) and(b)(1r)(a) and (b).
  • b) The state superintendent may deny, refuse to renew or refuse to revalidate a license to a person who has engaged in immoral conduct or incompetence. Wis Admin Code §PI 34.35(1)(c)(d).
  • c) The state superintendent shall deny a license to a person who has not met the requirements of licensure as provided in Wis Admin Code §PI 34.35 and Wis Stats §118.19.
  • d) The state superintendent shall deny a license to a person as provided in Wis Stats §118.19(4).
  • e) The state superintendent may deny or refuse to renew a license to a person who has provided a false, inaccurate, or incomplete application.
  • f) The state superintendent may deny licensure to a person whose license has been revoked by another state.

Background Check Outcomes

After all facts have been reviewed, a decision is made to either issue or deny the applicant's request for licensure.

If the DPI denies a license, the applicant has a right to an administrative hearing. At the hearing the applicant must demonstrate why/how the DPI erred in denying the license. The procedures for this hearing are found at: Wis Admin Code §PI 34.35(8). An applicant will receive written notice if the DPI denies a request for licensure.
