Sent: Friday, May 14, 2010 2:41 PM To – District Administrators and Open Enrollment Coordinators From – Mary Jo Cleaver and Merry Larsen, DPI Open Enrollment Consultants Subject – New Open Enrollment Legislation On May 12, the Governor signed into law two bills relating to open enrollment: 2009 Wisconsin Act 303 applies to pupils who are attending a K-8 school district under open enrollment and provides for them to be granted the same preference if they apply to the union high school serving the K-8 district as they would have if they were attending the union high school. See http://www.legis.state.wi.us/2009/data/acts/09Act303.pdf. 2009 Wisconsin Act 304 applies to pupils attending a school district under open enrollment who are habitually truant. The law provides that if a nonresident school districts determines that a pupil is habitually truant, the nonresident district may prohibit the pupil from attending the nonresident district in the succeeding semester or school year. Act 304 also permits a school district to deny open enrollment to a pupil who was habitually truant from that school district in the current or preceding school year. The Act does not permit a school district to deny open enrollment to a student who has been habitually truant from some other school district.
