Interim/Proposed Rules

  • newCertification of Compliance With Meal Requirements for the National School Lunch Program NSLP) Under the Healthy, Hunger-Free Kids Act of 2010
    • The Interim Rule on the Certification of Compliance With Meal Requirements for the NSLP was published on Friday, April 27, 2012. This interim rule amends NSLP regulations to conform to requirements contained in the Healthy, Hunger-Free Kids Act of 2010 regarding performance-based cash assistance for school food authorities certified compliant with meal pattern and nutrition standards. This rule requires State agencies to certify participating school food authorities (SFAs) that are in compliance with meal pattern and nutrition standard requirements as eligible to receive performance-based cash assistance for each reimbursable lunch served (an additional six cents per lunch available beginning October 1, 2012 and adjusted annually thereafter.) Effective date: July 1, 2012. Comments on rule provisions must be postmarked on or before July 26, 2012; emailed or faxed comments must be submitted by 11:59 p.m. on July 26, 2012; and hand-delivered comments must be received by 5 p.m. July 26, 2012 to be assured of consideration.
  • Fresh Fruit and Vegetable Program
    • The Proposed Rule on the Fresh Fruit and Vegetable Program was published on Friday, February 24, 2012. This proposed rule would establish the basic requirements for the operation of the Fresh Fruit and Vegetable Program (FFVP) in conformance with the Richard B. Russell National School Lunch Act. It would set forth administrative and operational requirements for FFVP operators at the State and local levels. The intent of these provisions is to ensure that the FFVP encourages the consumption of fresh fruits and vegetables by elementary school children, thus improving their dietary habits and long-term health. Comments period on this proposed rule ended on April 24, 2012.
  • Interim Direct Certification Rule
    • The interim direct certification rule was published in the Federal Register on Monday April 25, 2011 at 76 FR 22785. This interim rule amends regulations at 7 CFR 245 to require local educational agencies to conduct direct certification with the Supplemental Nutrition Assistance Program (SNAP). Mandatory direct certification with SNAP was required by the Child Nutrition and WIC Reauthorization Act of 2004. The interim rule also incorporates provisions from the 2004 Act concerning the certification of certain children who are homeless, runaway, or migratory or who are enrolled in a Head Start program.
